Chapter 13 Limits

my husband and i own three properties. they all have 1st and 2nd mortgages. the loans on the first two properties are in my name only. my husband is listed on the deed of just one. the third property's first loan is in my husband's name only, but i am on the deed. i have a heloc in my name on that property. i am looking to file a chapter 13 bankruptcy. will i have to list the first mortgage on the third property where my husband is the only borrower or will i just have to list the heloc.

i hope both of you are not filing bankruptcy jointly. in that case, you'll have to include the mortgage which is in your name. in your case, you should include only the heloc as it's in your name. i would suggest you to contact a bankruptcy attorney before you file bankruptcy. he will be able to guide you through the details of the process.

Thanks for your response. I have four loans plus the HELOC and my husband is not filing.

i would go into an attorneys office that is local to you and discuss this with them first.
