Bankruptcy Fraud

Someone I know file Chapter 7. The Chapter 7 was discharged (inactive) 30 days ago. Now they filed again for Chapter 7. Thougt you were only allow to re-file after 4 years . In the mean time the house income is 2 1/2 pay checks coming in. But only one income was put against the bankruptcy court. Does the second wife kids need to clear their income while living in the house during the Bankruptcy stages? By the way the house in foreclosure first then file bankruptcy.

a person cannot file chapter 7 within a month of the previous discharge. the person will have to wait for 8 years in order to refile chapter 7 bankruptcy.

if the second wife is not filing bankruptcy jointly with her husband, then she does not have to state her income when it is filed.

what happens when their was no equity in the home. Do you get to keep the home after the bankruptcy discharge?

Hi MHorn,

If your equity in the property is less than the state and federal exemption, then you'll be able to keep your home.
