I live with my boyfriend. Will his income be considered if I file for Chapter 7?

I live with my boyfriend and I am on Social Security. I contribute to the household by paying some of the bills and expenses. I have LOTS of credit card debt and I'm considering filing for bankruptcy. Will his income count against me? He's an authorized user on a couple of my cards, but I will remove him from them beforehand. We both pay the credit cards, it just depends on who has the funds when they are due. Does any of this matter? One more thing, he filed for bankruptcy a couple years ago, but it didn't involve any of the credit cards in question.

i don't think you would be filing bankruptcy jointly with your boyfriend. in that case, his income will not be considered when you file chapter 7 bankruptcy.

you need not to include income of your boy friend for chapter 7 BK.

Thank you all for replying. One thing I forgot to ask. The credit cards I have were obtained on our combined household income - that's what I always listed on the credit card applications. What effect will that have when for the bankruptcy I will be using only my income? The credit card companies are bound to notice the discrepancy between household income stated on the apps and the one stated for the bankruptcy.

You need to consult your bankruptcy attorney in this regard as the credit cards were obtained on your combined income.

I live with my boyfriend and infant son. He pays all the bills and the utilities are all in his name. I have nothing in my name. I have credit card (putting myself through college) debt and a repossion from college. My boyfriend is taking care of me right now because I don't have the means. If I file bankruptcy how would I do the parts for expenses, income and assets. if possible I would like to speak with someone. Thanks
Also do I have to include him in any of my bankruptcy documents. We are not married and have not been living together for that long. I don't want him to get invovle in my bankruptcy, how would I keep him out of it?

hi guest,

i hope your daughter is not filing bankruptcy jointly with you. in that case, her income will not be considered when you apply for it. your income, debts and assets will be considered while you apply for bankruptcy.

i have talked to an attorney, she has informed me that i have to include my boyfriends income. I refuse to do that considering that is something we do not discuss and it is do to medical bills, he has helped me out while i was off recovering, but since i live with him she says it counts

If you are filing bankruptcy alone, then I don't think you need to include your boyfriend's income. You should contact another bankruptcy attorney and take his or her opinion in this matter.
