chapter 7 convert to 13

i am currently in a chapter 7 and my wife ownes a house and now its considered mine and its worth over 239000 community property state coloado
can i change the filing and convert to a 13 the trustee is mad and i had no lawyer at first but now i do.

yes, you can convert chapter 7 bankruptcy to chapter 13. there are certain things which you should keep in mind when you are trying to convert one chapter of the bankruptcy to another. you should remember that you can convert the bankruptcy only once without court approval. thus, if you are planning to convert it for the second time, you'll have to file a noticed motion and convince the court that you are doing so keeping in mind the interest of your creditors. secondly, there are some debts which will be treated differently in chapter 7 compared to a chapter 13. also the obligations of a chapter 13 are much different than a chapter 7.

so if you have planned for the conversion, better consult a competent bankruptcy attorney.
