Will bankruptcy get me out of a joint-mortgage loan?

Posted on: 23rd Jun, 2010 01:18 pm
hi,

my ex-husband and i divorced a year ago, and i filed a quitclaim deed on the house. he refuses to refinance or file for assumption, claiming that it's too expensive. given that my only debt is this mortgage, can i file bankruptcy to get out of it? he makes the payments and has done so since we bought the house two years ago.

at this point, i really don't know what to do.
hi noodlyappendage,

filing bankruptcy should be your last option. if you want to get rid of the property, then you should apply for a deed in lieu of foreclosure. this will not help you sell off the property but you won't be liable for the deficient balance even.

thanks,

jerry
