My ex-husband and I had ford suv finance through first union my ex-husband turned the suv back to the back and of course they sold it. They placed a judgment back almost 10 years ago. My ex-husband recently filed bankruptcy and they they have informed me that my house is up for sell to the highest bidder in jan. 26th can they take my home? Iam not in any default of my mortage.
hi overcome,

you haven't mentioned what chapter of the bankruptcy is filed by your husband. if it's a chapter 7 bankruptcy, then the property can be sold off and the money gained from it can be used to pay off the creditors. if your husband is filing chapter 13, then you will be able to save the property. moreover, you haven't mentioned that whether the property belongs to you solely or both of you are joint owners of the property. if you solely own the property and the mortgage is also in your name alone, then i don't think your property will be sold.
