Mortgage Company Issue

Posted on: 28th Apr, 2010 03:21 pm
I've been in Bankruptcy since 2005, I'm about to be discharged within weeks. My Mortgage Company claimed $24,000.00 in arrears (My monthly payments are roughly $1700.00).

3 years ago I realized that the amount my mortgage company claimed as arrears was severely overstated and they have also been charging me extra fees per month through their attorneys. The attorneys had been sending me letters saying I was late on my Mortgage normal payments, This happened once every two months - After I realized what was happening I proved to them that they were incorrect and sent them a Certified letter telling them to cease and decist. Their Attorney broke off all communications with me after that. My Mortgage company removed their account from my credit report and will not speak with me either. Over the past 3 years my BK attorney has sent them QWR's, I've sent them Qwr's and requests for them to explain the added and extra fees and they refuse to answer either of us.
What are my oprions? What should I do if the amount claimed in arrears is found to be incorrect, to the tune of thousands? My attorney could not tell me what to do or didnt want to take the time. I recently fired my attorney and made a complaint with the State Bar.

How does one get the Mortgage company to answer my QWR? I was able to put together a payment history that shows there is a problem, now I dont know what to do with this information. My Mortgage company claimed an extra $10,000 in arrears and have charged me late fees and additional fees that they will not tell me exactly what they have charged me.

Is there something that I can do about this? Help!!!???
Hi thaone!

Welcome to forums!

If you can prove that your lender has charged you extra dollars in arrears, then you can definitely take legal actions against them. I would suggest you to contact an attorney and check out what steps you need to take in this regard. He will be able to guide you in the best possible way.

Feel free to ask if you've further queries.
