As you've filed for Chapter 7, you will get the option of reaffirming the debts. If you reaffirm your mortgage and keep on paying the dues, then you will be able to save the property.

I got a letter from the banks lawyer and I called and they said that the house is going to be sold on january 12th 2010
If I get a lawyer I could keep my house or what are my chances?

I guess you haven't signed the reaffirmation docs and thus your property will be sold off to pay off your creditors. You will have to speak to your bankruptcy attorney and take steps to reaffirm the debts. If your bankruptcy filing has been discharged, then you will have to reopen the file and reaffirm the debt.
