Reaffirming after Bankruptcy

Posted on: 21st Mar, 2010 10:49 pm
I filed for bankruptcy in 2005 (I tried not to for four years) due to a year's layoff and medical expenses. I told my attorney I wanted to reaffirm my mobile home and my car as the car was nearly paid off. So all is good. My bankruptcy was discharged one month later and I got a call from my credit union asking how I wanted to relinquish my car. Totally shocked (I had continued my pmts.) I called my attorney and he said I didn't have to reaffirm either loan even after he told me he would take care of it in court! I have tried contacting my lender on the house by phone and letter but they don't respond -- the car is paid now paid off.

Whew...does anybody have any advice as to how to get my housing lender to recognize my payments as earnest and I won't flake out on them? I've done my due diligence the only way I know how.

Thanks. Oh, and I don't need to be beaten up over the bankruptcy please, I've done that every day to myself.

Thanks for all your help.
Hi pseibel,

You should have signed the reaffirmation agreement when you were in bankruptcy. This would have made you personally responsible for the loan and you would have been able to save your property.

As you haven't reaffirmed the debts, the lender would never report the payments to the credit bureau. Thus, it won't have any positive effect on your credit report. If you want to reaffirm the debts now, you will have to reopen your bankruptcy.

Take care.
