[font=verdana:574b749c32][/font:574b749c32] hi! i am thinking about filing bankruptcy but is unsure if i really qualify. i made some really poor choices in my teen years and now they are catching up with me and i am unable to pay everything off with my income. i have tried for as long as i could but just can't do it! i currently have $2700.00 in credit card debt(this is still after making payments for about 3 years) i've racked up about $5000 in pay day loan advances-what ever i did i was unable to get out of these pay day advances and haven't been able to begin to pay them. i also overdrafted my bank account when i was 18 and its now up to $1600.00- i only make about $31000.00 annually. i am a mother of 2 boys under the age of 5 and on top of that my husband just lost his job. my paycheck is getting thinner and thinner. i went to a debt consolidating company and they basically told me that they couldn't help me because my debt was mostly pay day loans. i can't afford to have my wages garnished. please help any advice is greatly appreciated
Hi jwhite
You want to file bankruptcy mainly for your credit card debts and pay day loans. What type of bankruptcy are you planning to file - Chapter 7 or Chapter 13? If you are planning to file Chapter 7, then you will have to qualify the Means Test. I would suggest you to contact a bankruptcy attorney and take his opinion in this regard.
Thanks.
