Would bankruptcy affect my chances of getting a permanent home loan modification?

Posted on: 26th Oct, 2010 05:34 pm
hi,
i've been paying my home loan modification for over 6 months and i'm still waiting it to become permanent recently i filed for chapter 7 bankruptcy and when i try to get my reafirmation from my mortgage company they contact my lawer and told him that they order a court for the money that i owe them. does that means that they my try to take my home?
Hi arisleydataylor,

As you've filed bankruptcy now, the lender will not be ready to give you a permanent modification unless your bankruptcy is discharged. If the lender asks the court to remove the automatic stay and if the court agrees to it, then the lender can foreclose the property though you've filed bankruptcy.

Thanks
