Bankruptcy dischage

Posted on: 18th Jun, 2012 12:13 am
I have a furniture store loan which has been included in my bankruptcy filing. The bankruptcy filing has not been discharged yet. I haven't reaffirmed the debt and don't intend to even. The furniture store called me up and asked me if I want to let them come and get the furnitures. Aren't they supposed to wait till the bankruptcy gets discharged?
Hi kwasy,

Normally, the furniture store should have waited for the discharge and then contacted you for the repossession. It will be better if you could have a word with your bankruptcy attorney and then decide what to do in this regard.

Thanks

Hi kwasy!

Welcome to forums!

You can discuss the matter with your bankruptcy attorney as suggested by James Hogg. He will let you know whether or not the furniture store has the right to call you when your bankruptcy is on going.

Feel free to ask if you've further queries.

As the jameshogg said it is better to take advice from your legal adviser or attorney as you can find better solution from them. Mostly you are allow for discharge.

Yes, as per my knowledge they can wait for some genuine time for bankruptcy discharge to move the furniture. You can consult your attorney for better information.
