Bankruptcy/tax refund

Posted on: 20th Feb, 2013 03:40 pm
Hello, It has been since aug 21, 2012 when i filed my bk. I have seen the trustee already. I decided to call the court to find out whats going on. The lady said they were waiting on a copy of my 2012 tax return. she asked me if i was expecting a refund or have got a refund and i replied yes. That was it, nothing else was told to me. I talked to my sister and she said they may take a portion or all of my refund but I didn't know this until i spent $600 to pay on some of my bills. What do I do? Do I wait for them to call me or mail me something? I wouldn't spend my refund if i was directed not to and Why wouldn't they have informed me of this? I don't even know if this is by law. Need advice please
Welcome tlc,

The trustee may ask you to give up the tax refund which will be used to pay off some of your debts. As far as I know, you may be notified by mail that you may have to give up the tax refund. You should get in touch with the trustee and let them know that you have used a portion of the refund to pay debts. He may let you know what you need to do in this regard.

Hi tlc!

Welcome to forums!

Well, as far as I know, you need to give up the tax refund. It is strange enough that the trustee didn't inform you about it. Nevertheless, you should get in touch with the trustee and the bankruptcy attorney and get to know what you need to do in this regard.

Feel free to ask if you've further queries.
