adverse possession

we have been takin care of propery that runs along what is called a paper access road for 28 years. the road goes nowwhere except into the woods. No one cared about doing anything to make this piece of land look have decent so we decided 28 years ago to plant grass and put new stone on the access road. you see we live right on the boarder and all we saw when sitting on our deck was ugly weeds and scrub. I planted a garden with perninneals and grass. we mowed the grass and took care of the garden for 29 years. now the owner did a survey and said they can come in and make a Nature trailway as he sold all his land to the state. He never cared about the land before. we bought top soil and grass seed and the perrineals over 28 years cost a pretty penny. Do we have any right to this land for taking care of it for so long? we are in pennsylvania.

Usually adverse possession exists to put a statute of limitations on title disputes. For example, a landowner can be assured of his land without fear that long-lost heirs of a former owner from many years past can come forward and gain the title back to the land. With adverse possession, the person occupying the land for many years has claim to it.

You can contact an attorney and check out if your can claim adverse possession of that land as you have maintained it for so many years. A Pennsylvania based attorney will be able to let you know better in regards to the adverse possession laws of your state.

You can make a claim to property based on adverse possession if you possessed the property in an open and "notorius" manner for a certain amount of time. You should consult with a local real estate attorney to see if planting a property as you did fits within this definition. You will have to sue the other landowner for title to the property.
