quit claim deeds

Posted on: 30th Jul, 2007 02:00 pm
My father-in-law died 8 yrs. ago & left land in california for his kids. Seven days after his death a quit-claim deed was done on the property. Does this mean that someone forged my father-in-laws signature onto the papers? How can we find out who this person is?
a quit claim deed cannot be done after owner's death. the reason for that is owner's signatures are required on the deed. and the owner has to sign the deed in front of notary public. without proper notarization of the deed, deed is not valid.

you are saying that the deed was made after your father in laws death. if it is so then it has no value.

Hi Miller,

Without the presence of a grantor or property owner, a quitclaim deed cannot be done. When you are saying that it is done, it means that somebody has surely forged your father-in-law's signature.

But you don't have to bother about it as the deed is invalid without his actual signature. If somebody has forged also, he will have to show enough evidence in the court to prove it's authenticity.
