Note on mortgage

my wife died intestate in ca and we owned the house in joint tenancy. the house was mortgaged but in her name only. i know i take "subject to" the note, but do i have to refinance or can the note be switched to my name?

as the mortgage was only in her name, i think you will have to refinance the mortgage because you are the new owner of the property now. however, you can check with the lender if he allows a novation. but as far as i know, the lenders prefer refinancing.
