After Chapter 7 on a home PRoblem to buy a home! HELP

Hello, I filed Ch 7 on my home & discharged 1-26-10. I have heard I can buy a home again in 3 years of discharge and I have established my credit. SO her is my dilema. I moved into a home w/ a landlords verbal agreement to let me stay until her 3 years interest only was up and I could buy the home. But here we are 2 yrs into it as she found an Real estate Agent in her trailer park pushing her to short sale the home NOW! Going back on her word! I said 1/26/2012 I will be able to but the home, as she settled & said I am willing to let you live there only if you can purchase in a year. SO THE AGENT CALLS & ASKS FOR THE ADDRESS OF THE HOME I BK"D ON and said the discharge date doesn't count. The day the Bank with the *(deed) Takes it back is when you start counting the 3 years!! which makes it 2014! I called my BK attorney and my old friend a lender and said that is none of her business, and that is NOT true! But the Landlord trusts the agents every word! she is not a lender & doesn't have a copy of my credit report ??
Is it right of what she is doing?? My friends say she wants the Landlord to panic and start the short sale, and she doesn't believe me when I have to professionals discarding the Agents information> I don't know how else to prove it or to defend myself and my kids! Please anyone HELP!

Welcome to forums!

You have said that the landlord had a verbal agreement with you regarding the buying of the property. Well, verbal agreements don't count in this regard. The landlord can even deny the verbal agreement regarding letting you buy the property.

After a Chapter 7 discharge, you'll have to wait for 4 years in order to get a conventional mortgage and 2 years in order to get a FHA loan.

Ok the verbal stuff I already new about. Is what the agent doing any of her business is what I wan to know. Like I said I have a lender and my Bk Att that have pulled my credit and see Discharge of the home NO FORECLOSURE. The Lender getting me ready to get a loan on the 3rd yr, and BK att stated the same 3 yr time frame, so WHY is the Agent dismissing the discharge date and only going by the date the bank took back the home/deed or something like that?? If I already have a lender ready and she's an agent shouldn't she be happy or does she want to wait the year & munipulate the Landlord to not give me the year to purchase the house, so she can sell it quicker would and brainwash her to throw me out??

So again what is the procedure after Ch 7 discharge on a home and the time frame to get a loan to but another one. Why is she making it so hard for me?

Well my lender got a hold of the agent and put her in her place. She now has the correct info and we were right. She now knows our 3 yrs are almost up and she can leave us alone.

Hi Matt,

As far as I know, it takes around 60 to 90 days after the date first set for the meeting of creditors to get a discharge from your bankruptcy filing. After Chapter 7 discharge, you'll have to wait for 2 years to get a FHA loan and 4 years to get a conventional loan.
