How long does a Bank have to record a Deed

Posted on: 04th Sep, 2009 04:37 pm
The Bank foreclosed on a piece of property of mine 4 months ago a and bought it at the foreclosure sale. They have yet to record the deed in thier name. It is still registered to me at the courthouse. Issue is the property taxes still get billed to me. So is there not a time limit they have to record the deed. 4 months I think is plenty of time. I asked the bank about it and thier answer is they have been busy and will eventually get to it. I live in North Carolina.
There must be some type of documentation (with a date on it) which indicates that the property was taken from you during the foreclosure process. Just supply a copy of that to the tax dept.

as a result of foreclosure sale, bank must have given you some documents/ notice. you can use them as an evidence

I have the documents of the foreclosure. I have showed them to the tax dept. But the Tax Department says I am responsible for the property taxes until the bank records the deed.

Hi Elisabeth,

If the lender does not have the time to register the deed, then I would suggest you to take the initiative and register the deed. You can get in touch with a real estate attorney and he will help you in this matter in a better way.

Take care.

I refinanced my house about 3 years ago however the new mortgage lender has not recorded the deed. The Deed is actually released to me from the priouse mortgage lender. Does that mean the mortgage holder does not own the property I live in DC

EJ, you own your own home regardless of whether you mortgage it or not. The bank with whom you refinanced has a lien on the home and that's that. Why they take so long to file a deed is anyone's guess, but it only jeopardizes their position. It has nothing to do with ownership of the home at all, and you needn't worry about it at all, frankly.

I did a deed to lieu with the bank in may 2010 signed all the papers and they still haven't recorded the deed, now the house received a violation tickets after 2 months. Am I responsible for the tickets or they are since they owned it now.

If the property is still in your name, then you will be liable for the violation tickets.

Since the property is clearly not your own any longer, you need not concern yourself with "violation tickets." What are they, anyway?

The lender owns the home - you transferred title and you ought to have proof of that (I hope you do)...the lender's delay in recording is simply sloth on their part, or forgetfulness or something of that sort.
