WHY DO DEAD PEOPLE HAVE TO PAY BACK MEDICAID?

As far as I know, they are quite justified to ask you to pay for the Medicaid. They will go for a estate recovery program. Under this program, the state can file a claim against the estate of a deceased Medicaid recipient, who is 55 years old or above, who have applied for certain long-term care. Claims will include the cost of services, hospital care, and prescription drugs supported by Medicaid. Usually they go for the recovery after the death of the recipient. So, hopefully they have to send you the letter as a part of their duty to collect the costs of providing medicaid.

You can contact your state health department to get information on rules regarding pay back or estate recovery against a deceased individuals estate.

My brother had a triple by-pass surgery, paid by medicaid. My mom passed away and he will inheritance pmoney from the sale of the house. Does he have to pay back medicaid for the surgery.

Medicaid can claim assets from your brother in order to recover the money they had spent on your brother's surgery.

I have been on medicaid since I was 30, due to a stroke, unable to work all my life because of a brain injury at age 13. I am now 64. I am self sufficent, always was, lived basically on my own. My only asset is my home which is in a revocable trust in my 2 childrens names. When I die will the sale of the house have to pay back all the money spent on me since I first went on it 34 years ago, even thou I never entered a nursing home? Does the money for scripts and yearly doctors visits need to be paid back? How many years willthey go back for me, since the law was passed many years after I first went on it?

Medicaid may want to recover it's dues with the help of the sale proceeds of the property. You should contact a Medicaid attorney and he will be able to help you in this regard in a better way.

I am on medicaid while being pregnant and my children are also. If something happens to any of us am I gonna have to pay back for all the yrs my kids have been on medicaid

I'm facing this problem now. My mom has passed away and now medicaid is looking to collect $17,000 from her estate and I don't know why. She has never been in a nursing home or had anyone take care of her...so I don't understand why they would want that much back. If this a practice they are doing they should let the people no this before signing up. I think it's a unfair practice they are doing to get money back...

If your mother hasn't take any help from the Medicaid, then they shouldn't take over your mother's property. Speak to an attorney in this regard and check out what you can do in this matter.

Simone,along with their request for that $17K, they must have provided some kind of information about where they came up with that figure. I'm sure they didn't dream it and pluck your Mom's name out of thin air. Do you have any letters, etc. from them prior to this request?

If you lack any information from them to begin with, ask for it.

my mother is in a nursing home for 4 years, my disabled daughter and her family live in my mothers home will medicaid come after the home?

If your mother is taking Medicaid benefits while she is in the nursing home, then the Medicaid may come after the property in order to recover their dues.

They won't just pull the rug out from under you! There is a process, and in these modern and scary times, they're far more willing to renegotiate with you on the sale of the home, too.
