Removing property interest in TN by filing a quit claim deed

hi

i and my roommate bought a property in 2004. we just signed the refinance documents to be in my name only and i am buying him out for $x.xx. i am planning on us filling out a quit claim deed to remove his name from title. teh respective state is tennessee. is there anything else i need to do besides havinbg the deed recorded to remove his property interest completely?

I suppose you're on the right track. And just see that you get a notary public to sign on your deed and 2 other witnesses. Then get the deed recorded fast.

Ask an attorney to draft the deed as he knows what to put down in the legal language. Also, check out the TN laws as to whether you need to sign the deed as the grantee. That's because in many states, only the grantor (one who's transferring property interest) needs to sign.

can the person that gave up his rights to property come back and try to claim property if parties are married but separatee

Hi martha,

The person who has already given up his rights to the property cannot claim any ownership rights. Once he gave up his rights, he lost all his interest in the property and he cannot get it back unless the current owners of the property adds his name to the title again.

My husband and I are getting a divorce, if I sign a quit claim deed will the mortgage on the property still show on my credit report as me owing it?

Hi Kdawg,

A quitclaim deed will not remove your name from the mortgage. It will only remove your name from the property. Thus, the mortgage will still show up on you credit report.

quit claim deed signed in divorce by ex-husband. if he dies, will his life insurace be taken to pay on that house. girlfriend is beneficiary

If the mortgage is in your ex-husband's name, then the lender can use the life insurance of your ex-husband to recover the debts.
