How do I remove a deceased family member from deed?

Good Day,
> My brother, purchased land in Antelope Valley in 1982. 1/3 of the land belongs to him, 1/3 to our mother, (who died on August 8, 2008) and 1/3 to me and my husband. All our names are on the deed. We want to remove our deceased mother's name from the deed. We have a death certificate and since her will left us her estate, we want to try to sell the property in Lancaster. Please give me an idea how to proceed in removing her name from the deed so we can clear the title.
It is an Individual Grant Deed recorded in Los Angeles County on January 27, 1983. We are listed as tenants in common.

As you have said that the deed mentions all of you as tenants in common, the property of your mother will pass away to her heirs or the persons she mentioned in her will. It will be better if you could go for some legal help.

my father passed away, left the house to my sister, if she can get finiaanceing for the mortage and must stay in there for 5 years, if she can not she has to sell and slit it 3 ways , now can she get her name on the deed and sell the house with out us

to be perfectly frank about it, i don't see a pressing need - unless there is truly a need on your end. if the property was jointly owned (and hopefully on a survivorship deed), then there won't be any question that your mother in law is the owner at this time.

now if your intent (or her intent) is to sell the home at this time, it is likely that you'll have to go through probate to have title changed appropriately and get the sale accomplished.

and i'm no expert in these matters, so you'd be wise to contact an attorney who has some experience in these matters to guide you through the steps.

both my mother and i are on the house deed/mortgage satisfied-

Welcome SANDRA,

You will have to ask your mother to sign a warranty deed and transfer the property to you. Once she does so, you will become the sole owner of the property.
