TRANSFER OF TITLE

my aunt died and left me as executrix in her will. there are no claims against the property. i want to transfer title of home to the deceased son. there is no mortgage and all taxes paid up to date. should i file a quit claim deed or warranty deed. the will was probated as decree on muniment of title. we live in houston texas as well as deceased before expiring.

You can transfer the title to a property through a quitclaim or a warranty deed.

"I WANT TO TRANSFER TITLE OF HOME TO THE DECEASED SON."

But I don't understand this part. Why would you want to quitclaim to a deceased person? I don't think this is legally possible.

jenkin, i think that was a simple error on cindy's part. maybe it should have been a possessive, as in "deceased's" son.

Hi

George is right. I also think that this was a small error on Cindy's part which changed the meaning of the sentence completely. What Cindy is actually trying to mean is that she wants to transfer the title from the deceased person's (her aunt) name to her (the aunt's) son. Well, that can be done. As the property has been probated, I think, Cindy needs to submit the death certificate of her aunt and the papers of the probate court's judgment etc with the county recorders office, so they can remove her deceased aunt from the title and change it in her son's name.
