Hello,

I am married but my name is not on mortgage or deed in Maryland, what happens if spouse dies?...I have been married to my husband for 20 years. He bought our house shortly before we were engaged, and has never added me to the deed. Although he has refinanced several times, he has not added my name to the mortgage either. We still owe abou 100K on the house and have have two teenagers, one heading off to college this fall. I have been a stay at home mom for the past 14 years. Since I have no steady job history, no real property, and we are still in debt, I have asked many times over the years to be added to both the deed and the mortgage. My husband refuses saying that it will cost too much money to do so and that under Maryland Law, I am considered as an co-owner. Is this true? My friend says that not being on the title or the mortgage is totally unacceptable and is an horrible exampe for our daughter

As far as I know, if your name is not on the title of the property, you'll not be considered as a co-owner of the property. You can ask your husband to add your name to the title of the property with the help of a quitclaim deed.

Hi crystal,

Though you've build the house, if your name is not on the property deed, then you'll not be able to claim it as your property. Thus, you'll have to ask your husband to add your name to the property deed.

if my name is on the deed when we purchase our home and i am a co-owner can my name be removed to where i cant get half if i divorce?

Welcome nene,

Your name cannot be removed without your signatures and permission. If you transfer the property to your spouse with the help of a quitclaim deed, then you won't be able to claim any shares in that property.

I'm newly married and my husband and I just bought a house but I am not on the signed deed. Legally what issue can that cause?

Hi Blair,

If your name is not mentioned on the property deed, then you will not be considered as the owner of the property. Thus, you won't have any ownership rights on that property.

Welcome Marky,

You're one of the owners of the property as the property deed mentions your name on it. If you have the required credit score and income, you will be able to get a mortgage loan in your name.
