Can you buy a house while married and leave spouse off loan?

My wife and I are going through a divorce and its going to be another 3-4 months before all is done. I have the means and credit to buy a house, I even have one picked out. I know there has got to be a way to buy this house and leave her out of it. I'm a grown man living with my parents, brilliant, right? I got to get out of here and don't want to rent, I havent for years. Please help!!!
Any time you have some type of court case or action in court the lender would like to know. This is one of the question that is ask in the loan application (1003). The answer to your lies in the courts decision for your divorce, is it final? If the answer is yes, then you can definitely buy a house, but if it is still in dispute than no.

In many states the spouse is automatically place on title/deed, even if the spouse did not sign on the mortgage. The spouse becomes part owner of the estate. Keep this in mind.

I would recommend to wait until your divorce is finalized to buy anything.

i don't know about any automatic placement on a title, but i suppose anything's possible in these times.

there's no reason to hesitate, in my opinion. you ought to, at the least, go about the process of prequalification and see what you can purchase based on your current information. being in a divorce case isn't that big a deal insofar as "are you suing/being sued" questions on a loan application. if you're going to be obligated for child support or alimony, that will be a consideration, of course.

your attorney will have a better handle on the laws of your state, so consult with her/him to see if there's any issue with you purchasing prior to the dispensation of the divorce case.

depends on state, but usually the 'spouse' would have to
quit claim' their interest in the home, and you would take title as
'married, sole and separate property'
ie....the spouse would have to be aware of what you are doing
