Can I file bankruptcy if I am not behind on payments?

I have managed to keep payments made, but I can not go on like this any longer.
since you are not behind payments, will be difficult for you to go for bk.

I hope, you haven't received a bankruptcy discharge within past 6-8 years

As you are facing hardship in paying off the mortgage dues, you can file bankruptcy. However, in my opinion, it would be better if you could speak to your lender and check out the option of loan modification. In order to get a modification on your mortgage, you do not need to be delinquent on your payments always. Lenders may consider your offer depending upon your situation. If he is convinced about your hardship, he would give you a loan modification.
