How do I get my ex boyfriend off my deed

I live in CA. My ex boyfriend is on my deed with me. The loan is in my name because I'm the dumb one with good credit who thought we were getting married. We pulled out money equivilent to what he should get if I would buy him out. I can prove he received this money while we were together. We have since broken up. He moved out he lost his job and he stopped paying me his portion of the mortgage. I cannot sell, refi or anything because he is on the deed. He refuses to sign a quitclaim deed. Do I have any kind of legal recourse I can take? This is the biggest mistake of my life. Please Help!

it is very sad to hear about you. better consult an attorney. also i donot think that you have much equity in the house. you inform him that either he signs a quit claim deed in your name or you are going to stop the payment to lender & will be going for forclosure.

if he is not ready for a solution you inform to your lender. also you can file a case against him as you must be having down payment & mortgage payment proof. there is a mortgage on property so he can't do any thing as per his wish

Hi teetoeb,

You can go for a partition law suit if your ex-boyfriend does not want to transfer the property deed in your name. You can contact an attorney regarding this lawsuit. The court will judge the whole situation and they sell off the property. Once the property is sold off, the mortgage will be paid off first and then the rest of the amount would be divided amongst both of you.
