how to remove my name off mortgage loan

i purchased a home initially by myself and then later added my brother to the title. now i am trying to move and leave him the house but i do not want to be on the mortgage loan or title. what are my options for removing my self, so i can purchase another home?

welcome to forums!

you can quitclaim your portion of the property to your brother. once you do that, your brother will have to refinance the property in his name. this will remove your name from the mortgage docs. but for refinancing the property, your brother needs to have a good credit. otherwise, the lender will not be ready to refinance the property.

The only way to remove you from mortgage is for your brother to do a refinance in his name only. As long as he can qualify for the payments and has at least a 580 credit this shouldn't be a problem.

If you try to buy another home before that happens the new lender will require you qualify with both payments.

My soon-to-be ex spouse refuses to do anything regarding refiance the house do that I can be off the loan and move on with my life. Do I have any recourse at all?? What am I to do???????

Hi lindylou,

To get your name off the mortgage, you need to refinance it in your ex-spouse's name. you need to negotiate and persuade him/her to get it refinanced. I don't see any other way by which you can get rid of your loan liabilities.

what if the mortgage is in my husbands name,but the ex-wife is living there.she hasn't refinanced,but the house is going into forclosure and she is filing bankrupcy?

Hi michellereszka,

If the property goes into foreclosure, your husband's credit will be badly affected. It will go down by 250 points. Moreover, the lender will also have the right to sue your husband for the deficient amount.

my exhusband and i are divorced and i am trying to remove my name of the morgage loan. is there any attorney that can help me do this.

lucy, the most effective way to eliminate your obligation is for your former husband to refinance the existing mortgage.

did you have legal counsel in the divorce action? was there an order issued by the court to provide for your removal from the mortgage?

You can definitely call up the bank or go there particularly and apply for the same and also get a no objection from your brother too

How can I remove my ex-wife's name from a home loan? We filed bankruptcy and it has been a year since we paid it off (it was for credit card debt only). I have a court order to remove her name but cannot get it off due to only being out of bankruptcy for one year. I have been told that I must be out for two years. What can I do?

Hi Hermie,

You will have to wait for at least 2 years after a bankruptcy so you can refinance in your name removing your ex from the mortgage. Is there any urgency to remove her from the loan immediately? If no, then I think you should let it be as it is for another year. In the meantime try and build your credit so at the end of the 2 years after bankruptcy, you can refinance the loan in your name at an affordable rate.

we currently owe 10 years on our mortgage. we are divorcing. I retired last year and receive a pension. I want to keep our home. She is willing to leave her name on the mortgage because by income will be hard to qualify for a refi. As long as I make the payments can there be any negative factors on her end

Hi ray,

As long as you continue making payments, there will be no negative effect on the credit of your soon-to-be-divorced wife. The lender also would not mind in whose name the loan is and who has been making the payments, if you are current on the loan and there are no late payments.
