Mortgage Servicing Fraud

caught my attention earlier today. I've actually been fighting an illegal foreclosure on my home in NH initiated by SPS back when they were known as Fairbanks Capital Corp. for 8 years now. I was one of 281,100 Federal Trade Commission-certified victims of Fairbanks as certified in USA/Curry v. Fairbanks http://www.ftc.gov/fairbanks .

Mortgage Servicing Fraud can happen to literally anyone with a mortgage regardless of whether you are current or behind in your monthly payments. There is plenty of information on the web about MSF at this point so I won't take up space rehashing it here but suffice it to say that Mortgage Servicing Fraud is not limited to Fairbanks/SPS. There are at least a dozen other mortgage servicers using similar business practices.

Some of the biggest things that I can suggest for anyone facing foreclosure or even just more interested in the topic are:

1.) Educate yourself. The information is out there. You need to be proactive and help yourself in order to be able to find others to help you.

2.) Don't assume that you've already lost and give up the fight before you truly need to. Even to the point where, if you ARE foreclosed upon (regardless of legitimacy of the action), note holders are moving so incredibly slowly these days that you may not actually be under as much pressure to vacate your property as you think. I have seen media coverage of borrower foreclosed upon and still living in their property six months or a year after the foreclosure action. It is definitely a roll of the dice, but it may be time that you need to mount a successful defense to a potentially fraudulent foreclosure.

3.) Make sure that the foreclosing entity actually has the legal standing TO foreclose on you. That means making them produce the ORIGINAL NOTE. Not a copy of it, not a copy of the mortgage but the ORIGINAL NOTE. In order to better understand why you need to do this, search "Where's the Note, Who's the Note Holder" by the Hon. Samuel Bufford and the Hon. Glen Ayers.

Mortgage Servicing Fraud is part of the securitization process of loans and it isn't going to go away any time soon - at least not unless people begin educating themselves and demanding criminal prosecutions for blatantly criminal acts by servicers, note holders, trustees etc.

Thank you for sharing the information with the community. Your experience as well as suggestions will help a lot of people dealing with mortgage fraud. I agree with you that mortgage fraud can happen to anyone and it is very important to be proactive. Being proactive would help borrowers in saving themselves from further harassment.

this is really a nice peace of information and really a great source of inspiration for those who have already lost hope to fight against these big jiant organisation because person is just helpless due to their so call up to date records.
