Warranty Deed

I purchased a house in 2006. My ex fiance was a loan officer and convinced me that with my perfect credit to get a ridiculously, huge house with a huge mortgage. We have since split up and he stole all the original docs for the home. He has now added himself to the deed, home owners insurance policy and now harrassing my renters to add him to the lease agreement so he can collect the monthly rent. The clerk of court informed me that there was nothing they could do because he had the original deed. I am fearful that he will collect the rent and leave me stuck with the entire mortgage or worse, kick my renters out forcing me to pay the entire mortgage. What can I do?

If the house was in your name then he cannot add himself to the deed. Your signatures are required on the deed. And if you haven't signed on any property transfer deed then it is a fraud and you can file a lawsuit against him for that.

Yes,

I agree with Miller that if the deed was in your name, then how can your husband add himself to the deed without taking your signature? In that case, the deed may not be valid as you have not signed on it.

I think you should take immediate legal action against him.
