Need to know how to get Equifax to remove "Consumer Disputes

Posted on: 29th May, 2011 07:44 am
I need anyone's help with how to get 2 accounts through Equifax updated to remove a comment that says, "Consumer Disputes this account information".

I am applying for an FHA loan and this came up with the paperwork, with these comments I cannot move forward we are at a complete deadlock since the FHA guidelines absolutely will not allow these comments.
Initially this was reported through all 3 bureaus, Experian and TransUnion removed immediately with no issues. Equifax made me file a dispute to remove the comment, when it came back the comment remained and the "resolution" says all account information verified???

I called a second time and was told that I need to contact the creditor to have the comment removed. I called the creditor and they said it is my comment that I have to talk to Equifax to have it removed. I have sent certified letters to both Equifax and the creditor stating I don’t dispute the information and to please update it to no longer have the comment.

My mortgage officer has no idea what to do, neither do others that I have talked to. I disputed this information initially because my mortgage officer said if I didn’t know what it was to dispute it so I can get the information and since it is so old they may not even come back with anything, which never happened it just came back as verified – but that was 6 months ago. These are both through one creditor and both old medical accounts.

I have been told by several lenders to not pay these accounts because that will hurt my credit, unless they agree to remove the comment and send me something in writing stating that, so that is what I am trying to do but the creditor has no interest in removing the comment with account paid or not, they are claiming that it is my issue with Equifax not with them – but they will not even send me something in writing to that effect so I can show Equifax.

I see that this has been an issue with many many people but no one has posted an actual resolution…. Anyone please help, but initial deadline has passed we lost the house we wanted and now we have less than 2 months to figure this out or get into a rental lease for another year.
Thank you
Hi JessicaLeekley!

Welcome to forums!

You have mentioned that you did send Equifax as well as your creditor letters regarding removal of the comment from your credit report. Now they will have to take steps in order to remove the comment from your credit report. You should keep on negotiating with them regarding the same.

Feel free to ask if you've further queries.

Sussane,
Thank you. Do you know if they have a timeframe to do this? Each company is saying it's not something they can do to contact the other company - it's back and forth and the creditor will not acknowledge in writting that I have stated I don't dispute the debt which is the only way Equifax says I can ask to have it removed.... what else can I do is there anything legally I can use to back me up?

Hi JessicaLeekley,

Well... I don't know about the time frame but I will suggest you to keep all the documents related to your conversation with yourself. You can even contact an attorney and he will better assist you in order to know how you can deal with this matter.

Thanks

Well thanks for the advice. They finally updated it now I just have to go through the process with the loan company and finding a new home to bid on.

If anyone reads this I hope this helps:
To get Equifax to remove the comments the first step I took, which worked for 2 items but not the other 2 is:
1st: File a dispute to dispute the comment. To do this you must call or do it in writing you cannot do it online, there is no such option online. The secret number to call and get a real person is 800-846-5279 they will ask you for a confirmation number, which you wont have, tell them quickly what you are trying to do or they will hang up on you – literally they will hang up on you. If this process comes back and the items remain then try the second step.

2nd: I had to send letters to both Equifax and the creditor stating I don't dispute the items these letters need to be certified to get any kind of action. I sent the letter to Equifax along with a copy of the results of the dispute highlighting the specific comments I was requesting to be removed. Theyll open another dispute, if the comments are still there move to step 3.

3rd: I had to wait 10 days before I received the certified letter receipts back, then I mailed a second letter to Equifax with a copy of the first two letters and the certified letter receipts showing I told both Equifax and the creditor I do not dispute the items. At that time Equifax opened yet another investigation and the comments were removed in about a week because I proved to them that I notified both the bureau and the creditor that I dont dispute the items.

Caution to anyone going through this Each time I started a new dispute my score dropped 4 points and when the results came back it dropped another 2-4 points. Total damage to my credit just to have the comments removed was 20 points. Total time to get through this process was 60 days – but the first 45 were the initial disputing of the comment, after that is was fairly fast.

Thank you so much JessicaLeekley. I am going through this myself. I can't believe how difficult it is to have my OWN dispute removed! This is just ridiculous. I realize i have to write the letters to both the credit bureaus and creditor i disputed initially, but this should be simpler. So easy to dispute yet so difficult to 'un-dispute'. Your comment has been printed and will be very helpful. Thank you!

We are approaching our close date of 6/29 and Equifax won't remove the additional comments "customer disputes" - I have been fighting this since February and the creditor won't help because it's an "Equifax issue". I'll send an overnight letter to both the creditor and bureau stating that I don't dispute the account information and see if that works. I've phoned the creditor, but haven't written to them yet. Thanks for this chain - I've desperately been trying to figure out how it can be resolved.

I am having the same issue and found it was very easy to get the dispute comment removed from experian and trans union, howeve equifax has been a real pain. I have had the same response when calling and have now been told I need to wait another 30 days for something that experian was able to complete in 3 days. I am so frustrated.
I would love if someone had a quicker solution to dealing with Equifax.

You need to contact Equifax and ask them to take them the required steps asap! Continuous pursuing may coax them to do things faster.
