LIEN

Posted on: 04th Aug, 2010 02:05 pm
I recently won a default judgement through small claims court in Toronto. I put a lien on the home, but found out that her name isn't on the title. She is definitely married to the title holder. I found out that the house is up for sale. Will my lien still be valid, and will they have to pay me before the sale is final?
Hi BRUCEL!

Welcome to forums!

If the concerned person's name is not mentioned on the property deed, then it doesn't make sense to place a lien on that property. I don't think you would be able to get back your monies once the property is sold off. Nevertheless, you should speak to an attorney and take his opinion in this matter.

Feel free to ask if you've further queries.
