Old judgments

Hello all… I'm new to this forum and hope that I'm on the right page… My husband has 3 unpaid judgments, two of them are more than 10 years old and the most recent one is 9 years old. . None of these judgments are showing on his credit report. Are there any chances that my husband will get approved for a mortgage loan? Are the lenders going to run a public record search as well as a credit report?

If your husband's credit report does not mention any of the judgments, then he won't face any issues in getting a mortgage provided he meets all the other required criteria of the lender. As far as I know, the lender won't pull out the public records before giving him a mortgage. If something negative is mentioned in the credit report, then it might be a problem for the borrower.

There's a chance, but remember that the loan app may ask questions about whether or not you have any unpaid judgments or tax liens, etc. You can choose to lie, but that could come back to bite you in the butt if they do happen to find out about them.

Every lender I ever met (since 1983) gets title search and lender's title insurance as part of the mortgage process.
Every title search includes a judgemnt search (upper and lower court searches)
The judgements may be on title search but not on credit report.
The judgments need to be refiled every so many years, varies by states, so even though you know about them, maybe they have expired.

If the judgements were filed in other states than where you are buying, they would not show up--the searches are by state, not nationally.
