Paid collection off in 2004 and still getting calls today...

Posted on: 04th Dec, 2008 11:14 am
I had a credit Card with HSBC in 2003, defaulted on this but did pay it off in Oct 2004, got a call last night from a Lawyer Firm saying that I am going to be summons on this debt and I needed to pay it off, I got the account number for the person called HSBC and was told by them that is was charged and sold off, I ended up calling 3 different companies that is was sold off too until I ended up at the same lawyers company. The thing is I did pay this off, I don't have any proof of this unfortunately and HSBC does not have any record of my payments...is there anyway I can not pay this amount or pay less that the $900.00+ they are asking for...
Hi jjaye!

Welcome to forums!

Whom did you pay off the defaulted money? If you paid to money to a collection agency, they should have the proof for it. If you paid the amount to HSBC, they should have the details of the payments. Moreover wasn't the payments of the defaulted amount reported to the credit bureau? You can check out the credit report and see if collections are mentioned in it or not. If the credit report shows that the payments were paid in full in 2004, then I don't think they can force you to pay it once again.

Feel free to ask if you have further queries.

Thanks. I paid the defaulted money to a collection agency, I cannot remember the name of this company nor do I have my paper work, I did a money order. On my credit report, it just say Charge Off, Charge Off.. not anything about paid to colection or anything. HSBC also said they have no record of any payment...I did call HSBC and they said it was charged off and sold and each company I called sold it off. The thing is when I paid in 04 HSBC still had the loan. Can this company really summons me, garnish my wages and double the amount etc. as he claims? What's the worse can happen?

Welcome Jjaye,

If you cannot prove that you have paid the debts, they will have all the right to summon you or garnish your wages. May be you will be asked to pay the amount once again. I think you should better consult an attorney and check what can be done to remove the "charge off" from your credit report.
