Rights of co-owners in joint ownership

Posted on: 02nd Nov, 2005 09:36 pm
I live in texas, and i own 20% of a house in joint ownership with 3 other friends. One of my friend is showing interest in selling. Can he sell it and can he sell it at his price. Me and my other friend dont want this. Even he doesnot have a lease and and he also not paying the rent. He is paying the taxes and insurances. What will be the rights of the other co owners to live/visit/have access to the house?
Hi Ken!

Welcome to the Forums!

You can ask her to sign a quitclaim deed in your name and give away all her interests in the property. If she does not agree then there is the option of "buying out co-owner". You will have to offer some money to the co-owner and in lieu of that the co-owner will leave the property. Regarding the loan issue, you can consult with the bank. I would suggest you to consult an attorney. The legal advice will be helpful for you.

Feel free to ask if you have further queries.

I had to leave my house with only personal property because my boyfriend wouldn't and was threatening me, physically. It was 2005. Our title on the house is JTWRTS and the mortgage is in his name.
He moved in a roomate (Girlfriend I think to help pay costs.) I had paid everything for 17 years including improvements and costly repair. He won't re-imburse half or even allow me on the property. What can I do?

Tired of it all and he's counting on that.

Hi Vicki!

Welcome to forums!

As you have a joint tenancy with right to ownership of the property, you have all the right to stay in the property. He can never force you to move out of the property. In my opinion, you should immediately contact a lawyer and discuss your case with him. The lawyer will guide you take the correct steps.

Feel free to ask if you have further queries.

my boyfriend closed on a house a week ago and said he was going to give me co-ownership. His plan is to go through a friend realtor that initiated the sale. Is that the correct process?

Hi char,

If you want to add your name to the property, you can ask your boyfriend to sign a quitclaim deed. This will make you one of the co-owners of the property. A real estate attorney can help him in this regard.

Thanks
