Mobile home foreclosures or repossession - What next?

My investor who wants to repossess my home is constantly harassing me. But I am still current on my mortgage payments. If we don't pay an insurance payment and miss any property tax, they say that they will be taking our home. I am currently staying in a mobile home park. Can you tell me, if I apply to HUD will they help us pay off the loan and move into some other place?
my father bought a mobile home in a senior park about 7 months ago, he also owns a mobile home in clearlake that is completely paid for he only has to pay space rent. recently his companion of 12 years passed away and he can no longer afford the mortgate payment because some of her income went to help pay the mortgage. we moved him back to clearlake trailer and am unsure what we can do to get him out from under this mortgage. also, if he defaults on this mortgage will they take his bank accounts, savings accounts or cd's to help repay the defaulted mortgage?

Hi annette

You can try to sell off the mobile home in California. However, if you sell off the property, then then lender will ask you to pay off the dues immediately. If the lender forecloses the property, then your father will have to pay the deficient amount resulting from the sale of the property. If he cannot pay the deficient amount, then the lender will garnish his savings account.

My husband and I own a double wide in a park. We are current on our payments (bi-weekly). I was laid off in January and he was three weeks ago. We have used our tax return and unemployment to pay our bills. We live in TN and can't find jobs. My husband has family out-of-state that have offered for us to live with them since we are not going to be able to pay our mortgage and eat too. We used to live there and his old employer offered him a job. We are told since we don't own the land, we cannot go through a mortgage company to sell. The payments come out of my account automatically. How can I stop the payments from being withdrawn so that I don't rack up bank fees? And do I just contact the mortgage company and tell them to take the house back?

Hi onyapax

You will have to contact the lender and apply for a short sale. For this you will have to write a hardship letter and let the lender know about your hardship. The lender will judge your financial situation and then decide whether he would agree to the request or not. As far as automatic payments from the bank are concerned, you can speak to the bank authorities and try to block the account.

My mobile home was repossessed last year in '07 (Texas). Now I'm getting notices that after my former house was sold for 9K, I owe a deficiency of 25K and change. I had this house for 7 years, for a total of around 39K worth of payments, the house was sold for 9K = around 48K total. The sale price of the house was 36K, a bank profit of 12K.
Can they sue me for the 25K? I do not intend to pay any more since they had the house and sold it. So, if they can sue, what other recourse do I have to get this out of my life for good? Bankruptcy?

Hi Marlon,

The lender can sue you for the deficient amount resulting from the foreclosure of the property. If you do not pay it, the lender may even charge off the account. I would suggest you to to speak to your lender and check out if he can forgive the deficient amount or not.

My job closed down and i got behind on my payments. I was in a Chapter 13. I was able to pay the Bankruptcy court all that was due to them, but it havent been discharge yet. Now the mortgage is declaring that im in default. what can i do? what is the next step for the mortgage company?

welcome to forums!

you will only be discharged of the chapter 13 bankruptcy, when you pay off the mortgage dues to the lender according to the new payment plan given by him. as you have defaulted the payments, the lender has the right to foreclose the property. you bankruptcy can also get dismissed in this process. in my opinion, it would be better if you could speak to your lender and check out if he can further reduce your payments or not.

In 2003, had to abandon mobile home, with ForSale sign in window, after not being able to sell it in Texas. 4 months later, another family was living in it. The company sold it. In 2006, recieved a phone call that I owed $36,000.00 on interest off of $7,000.00 in taxes. I was never informed of this, never received or heard anything about this mobile home until 2006. Here it is 2009, now I have a collection lawyer for creditor's calling me. This just seems so wrong on how the company went about it, never informed me of anything until they had a $36,000.00 price tag. Can they do this?

If you have not paid the taxes, the you would be responsible for paying it. As far as the interest is concerned, if the lender had foreclosed your property, then he can claim the deficient amount from you.

My mobile home recently got repossessed the land was not included in the note and I am wondering if the lender can legally sell the home from my property, they did and the people who bought the home destroyed structures (a porch that was not connected to the home and a fence that was not in the way) and stole items from the property.

If the land was not included in the note, then the lender would not be able to sell off the land without your permission. If the new owners of the property destroyed the land, you can file a lawsuit against them. I would suggest you to contact a lawyer and discuss your options with him. He will be the right person to help you.

I was a cosigner on a mobile home and it was repossed. can they garnish my wages if they sell the home and they don`t get every thing that was owed.

My mother had a heart attack and was out of work for a month. she got behind on a payment and they refuse to work with her. she has paid on the home for over 10 years now and they called her work on Friday and told her that someone would be there on Saturday to remove the home. we have 1 year left on the land through someone else. Do they have the right to call you on Friday and then come get it on Sat.? There is nothing open on Saturday so we cant call to get a U-haul or anything

To rmorquec - if the lender sells the collateral for less than what is owed, then there will be a deficiency that you would owe. if they seek a judgment and that is granted, and you fail to pay according to the terms of that judgment, then they can garnish your wages. it's a process, though.

To jason27 - usually repossession agencies don't give you advance notice. in the case of a mobile home, however, it makes sense to provide a little notice rather than just show up at the door with a truck to haul it away. it's only one payment that your mom is behind? that's pretty severe treatment by the lender if that's the case. can you or someone else help her? it may be pretty late in the game, inasmuch as it is now saturday and they're probably preparing to show up now.
