Property taxes past due

Posted on: 28th Jun, 2008 01:11 pm
I was appointed administrator of my Dad's estate. In the asset finding phase, property came up on the computer that there are taxes being owed by the Estate of one of his Aunt, who died when I was 12 years old. The taxes are in the rears to the tune of about $5,000...total,and thats on 8 differant lots. It is unusual that my dad would have ignored an issue such as this. All of his sibling are dead also except his sister so I decided that I'd contact her about the matter. She tells me that she did some research on it aslo and she concluded that to her it was not worth the bother and that people were living on the property. But my lawyer told me that I could not close out my father's Estate until I clear up this matter. So I go yesterday to the taxing authority of the county. and go look at the land yes, there is a trailer on the property. But I'd like to claim it for my self because it's family bought land, am willing to pay back taxes on it and keep it, what can I do, to gain such an asset without having my sister and brother having anything to do with it and the rest of the family, since noone want's it... because noone has money but me ....help please :!:
You will need to get the property transfered into your name and then get down and pay the taxes. The people living there can claim the property os theres IF they pay the taxes. It is called adverse possession (google it) but basically they can take ownership right out from underneath you if they have been there for 7 years and paying the taxes. Someone will jump in and give more detail but it sounds like you have some work to do through the probate system to get it into your name from the estates.

Good Luck

I agree with Brian here. possibly those occupying the property for the past few years may claim their possession through what's known as the law of Adverse Possession . So, if you can mention the name of the state where the lots are located, then I can tell you the time duration for adverse possession in that state.

Moreover, you need to get the title of the property (including 8 lots) in your name and only then can you pay the back taxes. And if none of your family members have the required money, then well, it's for you to pay and get the entire ownership rights.

Good luck
