If you had completed the purchase of the property within September 30, 2010 then you should be able to get the first time homebuyer's tax credit.

It only matters if she and her husband do. Both you and your husband must satisfy not only one of you. You can apply for credit, and your father should not be. If the father does not satisfy you can share the credit, or one person can claim.
