Mortgage, Title and Deed

I am purchasing a home in Florida. Yesterday was the closing but it did not close as my husband was not present. (He lives in another country with no American status). I was unable to close because the title company stated that my husband needs to sign the title and deed due to homestead regulations. He is willing to sign but I wanted to verify since he is not on the mortgage will he have any financial obligations. More specifically, can he sign a title and deed and not be liable for the mortgage.

Yes, he can sign the mortgage and not be obligated on the loan. In Florida, he does not sign a title and deed, he just signs the mortgage. He will be added to the title and deed as a co-owner by the seller.

Welcome to forums!

If he signs on the property title and is not on the mortgage deed, he will in no way be responsible for the mortgage payments. Neither will his credit get affected if you cannot pay the mortgage dues.

You need to consult an attorney in this regard. You will have fill out specific forms in order to change the documents in your legal name.

hi randall,

if you want to remove someone from the property deed, then you'll have to ask that person to sign a quit claim deed in your favor.
