Paying for Utilities on a Foreclosed Property

I am still receiving bills from the water/sewer company and HOA for my condo that I moved out of over 6 months ago. The auction of the condo was at the beginning of April, 2009, but I have been unable to find documentation with the County where the condo is located indicating that I have been foreclosed on. Where do I get the documentation needed to give to the water/sewer company and HOA to let them know that I have been foreclosed on?

You mean your condo had been foreclosed upon at the beginning of 2009? I think it's possible because the authorities have calculated the dues for the past 6 months. They're justified in asking for payments probably because your lender didn't pay them after the foreclosure. Actually, the bills from the water/sewer company and the HOA fees are something that the homeowners should be paying even after their properties are being foreclosed.

However, the documentation for the foreclosure can be obtained from your lender who offered you the mortgage for the condo. Or else, you may also receive the document from the County Clerk's office, where it is filed.

I have kept current on the HOA and water/sewer bills through this month (April 2009) even though I vacated the property and stopped paying the mortgage in September of 2008. The condo was scheduled to be auctioned (and I'm assuming was auctioned) on April 1, 2009. I have checked the County Recorder's website and can't find record of the foreclosure, only notice of default. Am I supposed to continue paying utilities on this property that has been foreclosed on and is no longer mine? I will try to call the County Recorder's office tomorrow for the foreclosure documentation so that I can send it to the HOA and water/sewer company.

If you are being foreclosed on, you can shut the utilities off once you vacate the property. If you have worked out a cash for keys option with the bank, the bank will usually instruct you in what to do with the utilities. Once the bank takes possession of the property, they will transfer the utilities to their name and take over maintenance of the property.

Bank is the owner now.

I ma in a property that is up for auction. They have had 4 extentions and I am still paying rent to them. Would you know approximently how long the extensions will go on before we are locked out. Also would you tell me if I should still pay the owners or the lender

i have been renting a house for 2 years and found out in march the house was in foreclosure since 10/11. I have been paying all utilities but have a question on the sewer bill. I know the owner is legally responsible and but i have been paying. I am disabled and can't afford to pay it. can i let the sewer company know it's in foreclosure so i can get the bill out of my name? We have never been notified by any bank or anything to leave. we had or have a lease.

Hi yahanny,

You can stop paying the sewer bill as you're not liable for it. The owner and the sewer company will decide as to what they have to do.

I heard a rumor that if a tenant has being living in a home for a total of 8 years, and 7 of those years the home has been in foreclosure and still isn't bought out by a new owner, and also that the tenant has proof of living by paying the utilities and all....with all this said, that there is some "Act" out there that states with proof of paying in these 7 years, the title of ownership of property transfers into the tenants name with legal action taken. is this true? is there an "Act" like this? and if so what are the details of it? (Florida specifically)
