we were mailed a certified letter saying that our time share was being forclosed on because of lack of maintence fee. We were billed 12/02/07 and again 1/22/08 for maintence fee. we misplaced the bill and in reality thought that we would get a bill in December of 08 that would be due in by January 15, 2008. On Sept. 25. 08 we received our foreclossure notice for lack of maintenance fees. On the bill which we found it states quote " Late fee policy: The above fees are due in full by Jan. 15, 2008. If the payment is not received by 1/15/08, a $25.00 late fee is applied. If the payment is not received by March 15, 2008 a 50% late fee is applied. If the fees are unpaid as of December 31, 2008 a 200% late fee is applied. we do not argue the late fees but see no reason that a foreclosure notice should be sent. The Reba Management Company turned our bill over to W. Thomas Vernon , Attorney when in reality December 31,2008 has not even arrived. That is taking action that is contrary to the statement on the bill. Do you agree?????? Thank you

In the note typed above and already sumitted I mistakenly put the due date of Jan 15, 2008 instead of 2009 when we thought that the bill was going to be due.

Hi fox!

If there is a late fee policy which the timeshare company follows, then you will have to abide by them. As far as the dates are concerned, I think you should talk to the Timeshare company and an attorney. Its better to negotiate than to let the property go into foreclosure. If you are able to pay off the dues along with late fees now, you should even try for that.

i don't agree that the foreclosure notice is too early.

as jameshogg noted, if you can pay these fees now, why not do so and avoid the whole foreclosure mess? you'll need to speak with the attorney to see what you can arrange.

as for the fees themselves: 200%!!!! wow, that's a load! not to mention, a ridiculous penalty; but you presumably read all those disclosures they gave you when you bought the timeshare...right?
