Timeshare quit claim deed

joshua, i have a timeshare in hawaii that i am trying to sell. the purchaser does not want to go through an escrow comapny. can i receive payment and then file a quit claim deed to the purchaser?

I suppose it will not be a good choice to get the payment and then file the deed. And why doesn't the purchaser want to go for the escrow company? after all either an escrow company or an attorney should be handling the title change issues.

I have the same question as adonis - why doesn't the purchaser want to use an escrow company? Doesn't he understand it is for his (and your) protection? In my experience buyers who don't want to use escrow or title companies don't want to pay the fees involved but this could end up being very costly in the long run.

Hi Dianna,

A quitclaim deed can definitely be used for a time share property. If you want to change the title of the time share by adding or removing someone you can always do that using a quit claim deed. After the deed is signed it needs to be notarized and recorded with county clerk's office in order to validate it.

Can I use a quitclaim deed for my timeshare. I want out of the timeshare. Tried to sell it. It is in the Cayman Islands. I own it. The maint. fee is up to date. In the magazine Time Shareing Today there is a article about doing a quitclaim deed and giving the timeshare back. I can not afford to pay the $750 a year maint. fee any longer.

Can I use a quitclaim deed for my timeshare in the BWI Cayman Islands. I own the timeshare and the maint. fee is up to date. I cannot afford to pay the $750 maint. fee anymore. The magazine Timesharing Today has an article about wanting out of a timeshare. The man who wrote the article says this is what he did (quitclaim deed).

how do property taxes work with quit claims? Also is there any restriction as to who you can quit claim to?

I take it the property has to be mortgage free? Otherwise the lender would need to approve the new owner right?

Hi Hid,

You'll have to ask the other person to sign a quit claim deed in your name. Once the person removes his name by signing the property deed, you would become the sole owner of the property.
