Was is the legal time after paying off a mortgage should the Deed of Trust be released?...I have paid of my mortgage in February (2008). I live in Texas, my mortgage company was in Houston and then sold to California. I had to call them in August (or September) that since I had paid off my mortgage I had yet to receive any kind of notice of my payoff or notice of release of Deed of Trust. They finally sent me a letter telling me that the mortgage was paid and the release of Deed of Trust would be submitted in a timely manner. But, they did not specify how long. How long should it take for them to release the Deed of Trust? And what is my course of recourse if the Deed of Trust is not released (or not releaseed in a timely manner)?

Congratulations! Its great to hear that you have paid off you mortgage.

The Public Trustee's Office checks and reviews the deed of trust for accuracy and then it is executed. After this, the deed is sent to the Clerk and Recorder for recording. Normally a deed of trust takes a couple of weeks to release. I think you will have to wait for couple of weeks to get the deed of trust.

If you do not receive the deed in a couple of weeks, you will have to contact the mortgage lender and check the reasons for delay.
