Ex-partner got discharged in bankruptcy

Posted on: 27th Dec, 2011 12:03 am
we don't want type of bankruptcy my partner's ex filed for but she has filed bk. and m partner has some mutual debts with her as they own a house together. the property is underwater and there are renters in that property from whom both of them receive payments. my partner takes care of mortgage payment for this each month with an additional 250 out of his pocket. the ex is responsible for the second mortgage on the property. she has now informed him that she left the house loans out of the bankruptcy. he got a notice from the bank where their first mortgage is today saying that the debt has been discharged. he didn't want this debt discharged. how can she discharge a mutual debt, without his knowledge?
your husband's ex should have informed him before filing bankruptcy when they had joint debts. now that she has received a discharge from her debts, she won't be liable for paying the mortgage. there are high chances that your husband will become liable for the mortgage payments.
