Filing bk in a non-community property state

Posted on: 30th Dec, 2011 02:05 am
Hello there, we live in a non-community property state. I'm planning to file bankruptcy. Do I have to list my spouse's savings account in my BK? FYI, her savings account never had my name on it. But the fact remains that her savings account is with the same creditor whose debt I want to get discharged in bankruptcy. Will that create a problem for me?
if your spouse is not filing bankruptcy jointly with you, then you don't have to list her assets or accounts in your bankruptcy filing. it does not matter if both of you have your savings account with the same bank. unless she files bankruptcy along with you, there's no need to include her assets in your bankruptcy filing.
