Getting divorced

Posted on: 20th Apr, 2012 08:02 pm
I am currently getting divorced and spoke to an attorney. He stated that since the Divorce process is ongoing, I should wait until it is completed to file a Chapter 7. He said that my situation currently does not qualify for a Ch7. I just know that after we split with my debt and child support payments of 350/wk, It'll be very hard to get by. We also have a mutual debt of delinquent fed taxes of 5k. All other debt is in my name only. I’m looking to just tell the courts in the div that joint debt. If they split it that would be great but, its mainly all in my name. Could this happen?
Hi Pam,

You can definitely request the court to divide the joint debt between you and her. However, as she is not working right now, I guess the court may not split the debt.
