My son and his wife separated and then finally divorced. Their agreement about their home was as soon as possible the house be sold. After 2 1/2 years of sitting empty, the ex wife agreed to let ex husband move back in. Now one year later, the ex wife as the co borrower is demanding the house be sold. The ex husband doesn't want to move, he doesn't have anywhere to go, and he is making the payments. Can she do have a realator come and put the house up for sale with out his permission?
if a realtor tries to put the house on the market without all parties' authorization, i'm quite certain that won't be acceptable. you can check out the website of the national association of realtors at realtor.org and i'm sure you'll find that to be the case.
in any event, a home cannot be sold without both parties' consent, unless decreed by a court order.
