What to do?

i got divorced 1 1/2 years ago. my attorney had me sign the quick claim deed, so he could refinance with out bothering me. the mortgage is in both names, but the note is in my name only. he had one year to refi. he has failed to do so. he also was not suppose to affect my credit. well, so far he has only made 2 payments before the over 30 days late. also he let it go for three months and it was going to go into foreclosure. low and behold he came up with over $2,000.00, to bring it current again. this all still shows on my credit only. i have taken him in for contempt twice, and nothing gets done because he makes excuses why he can\'t pay. he\'s a mortgage broker, go figure! i have asked about 7 different attorney\'s about this and they all say i\'m screwed. please help me!! i\'m remarried and would like to buy a new home.[color=black:0baacbe4ec][/color:0baacbe4ec][size=18:0baacbe4ec][/size:0baacbe4ec][

Welcome to the forums.

You have said that the mortgage is in both names while the note is in only your name. As far as I know, the note obligates the borrower to pay off the loan. In that case, both of your names should have been on the note.

Your credit is getting affected because the note states about your obligation to repay the loan. I think the only way to get out of this situation is to pay off the loan as early as possible and get rid of being harrased any more.

I wonder how it's possible that your name is only on the note but mortgage is in both person's names. I think you should talk to your ex-husband on this matter. Also, verify this with a copy of the note that the lender has with him.

If the mortgage is in both names as specified on the note, then you should contact the credit bureau and update your credit report. All the late payments which are now shown on your report will then be shown on your ex-husband's credit report.

Finally just try to prepay the loan and get out of this situation.
