I bought a house from my aunt using a quisl clam deed. She was awarded the home through a freind by way of quick clam. Should I still do a title search of the home and property to insure no leins
Hi Richi,

It is not required to do a title search but would certainly be advisable as you had received the home from your aunt and she herself had got it from one of her friends.

You can not be certain if there were any previous liens before your aunt's friend gave the home to her.

hi,

i would like to add that you should get the quit claim deed properly notarized and recorded at the county recorder's office if you have not done so, it will make the deed valid and enforceable.

yeah, you can do a title search, there 's no harm in examining your title and trying to find out if there are previous liens on it.

The deed was notirized and completed by an attorney. It was also recorded at local court house. So is this good enough

Hi Rich,

After the quit claim deed is notarized and recorded it is a valid deed for property transfer.

But do let us know if you had done a title search and what the result came out of it. I think there was nothing wrong with the property title that is why you went through with the recordation.

No I did not have a title search done. At the time I didn't anything about a title search. But the original ower died, left property with my aunt who later sold it to me. So should I have a title search done or is there a way that I can do the search? If so how do I go about searching the title?

Hi Rich,

In a title search the public records will be checked and normally a title company conducts them. It may be difficult for you to do the search on your own as it involves checking all the liens that might be linked with the home.

I am planning on buying another property. I had an attorney do an O&E search and come to find out their is a lien because one of the original owners died an there was not a death certificate recorded. What should be done about this. Should I have the seller of this property take a death certificate to be recorded so the lien can be lifted or what should I do?

Hi,

If it would be possible for the seller to locate the death certificate of the person then I think you should ask for it being recorded.

As this is the only lien which is showing on the property then why not clear it up if it can be possible.
