who is responsible for costs of pertition lawsuit? Are costs borne by person(s) initiating suit or do costs come out of final proceeds from sale?

It will depend upon the parties who are fighting the case to decide how the costs of the lawsuit will be paid off. However, there are high chances that the cost would be paid off by the person initiating the lawsuit.
