quickclaim deed

my boyfriend purchased a house back in 1997 we did a quick claim deed throug a lawyer. how can I get part of my equity because he wont sell the house he refinance the house 2years ago .thanks daddy
What happens when a co-owner of property decides to buy you out of your interest or sharein the property once a appraisal is done? How will it be distrubted in one large amount or several monthy payments?

Whether the payment will be distributed in lump sum or through several monthly payments depends upon what the co-owner intends to do. But as far as I know, asking for a single payment in lump sum is preferable for the co-owner.

my mortgage is in my name only but my boyfriend at the time signed the deeds paper that tates when the house is paid off the deed would be in both of our name and now we are not together and i cant sell my house without him being present. what do i need to do to sell without him.

Hi shelise givens,

Welcome to the forum.

I think you should have a talk with your boyfriend and request him to sell the house or quitclaim his share of the property to you. Otherwise you can even buy him out. That means you can pay him for his share of the property. Even after that he does not agree with that you can file a Partition Lawsuit and divide the proceeds accordingly.

i was divorced in 1998-the agreement being he would let me and the children stay in house until nov 2011 when my youngest turns 18 if i signed a quit claim deed. his obligations would be to pay off all credit card bills, take care of all majors repairs and capital improvements on the home, as well as creating a will leaving the house to our three children
he has not fullfilled those obligations and i have not yet signed the quit claim deed. we are about to go to court for the third time over this
the last time was 2006 at that time the judge ordered him to make certain repairs on house within 30 days and gave me the same time to sign the deed . he didnt do the repairs, so i didnt sign the deed
can the court force me to sign the deed or can i do a partition ? can the courts sign the deed for me ?

Welcome to the forum.

You can file the Partition Lawsuit but whether the court will force you to sign the quitclaim deed or not that totally depends upon the Court. But I would suggest you to consult with an attorney ASAP.

It's good that you didn't sign on the quitclaim deed. After all, your ex-spouse wasn't paying the obligations. So that's the right step you've taken. But does this mean you haven't been paying your bills and are they all your obligations? I mean aren't the bills in your spouse's name too?

The court cannot force you to sign the deed. And they cannot sign the deed on your behalf. But yes, I do see the possibility of a Partition Lawsuit being ordered by the court. In such case, the proceeds will be divided amongst both of you but I think you'll have to use it to pay off your debts or else your credit would get the hit.
